Dollar Tree Stores, Inc. is on the receiving end of a proposed collective action that alleges the defendant failed to pay its assistant store managers proper overtime wages. The plaintiff in the case claims she was paid $11.50 per hour and worked more than 40 hours per week, many of which the case says were unaccounted for in the defendant’s timekeeping system. The woman argues that she and other assistant managers were not compensated for times they worked off-the-clock performing pre- or post-shift duties, such as depositing money in the bank, preparing the store before it opened, and handling post-closing responsibilities.
On top of that, the suit alleges, employees were not provided with uninterrupted meal breaks each day, and the plaintiff says she once received a disciplinary note for attempting to clock in before her break was over despite being forced to work through it.
Originally filed on February 9, 2018 in Florida state court, the suit has since been removed to District Court for the Southern District of Florida.
