A dock worker formerly employed by XPO Logistics Freight, Inc. has filed a proposed class and collective action against the company claiming he is owed unpaid wages.
A former employee of XPO Logistics Freight, Inc. has filed a proposed class and collective action against the company claiming he is owed unpaid wages. The plaintiff says he was employed as a non-exempt dock worker and was responsible for unloading trucks and cleaning the dock. According to the complaint, he worked approximately 50.5 hours per week without receiving time-and-a-half overtime pay for the hours he worked over 40. The plaintiff says he complained to management about the defendant’s pay practices and was told that employees only receive overtime after working 51 hours per week. Soon after, he was allegedly terminated with the explanation that his services were “no longer needed.”
The suit further alleges that the plaintiff and other dock workers were not paid spread-of-hours or split shift wages and were not provided with proper wage statements.
