Disparti Law Group, P.A. and an individual owner are on the receiving end of a proposed collective action filed by a case manager who claims she was not paid proper overtime wages in accordance with the Fair Labor Standards Act.
Disparti Law Group, P.A. and an individual owner are on the receiving end of a proposed collective action filed by a case manager who claims she was not paid proper overtime wages in accordance with the Fair Labor Standards Act (FLSA). The plaintiff claims the defendant failed to properly record and compensate her hours worked (though she routinely clocked in and out each day) and paid her by personal check at her straight-time rate for all hours worked above 40 each week. According to the suit, “[t]his disguised method of compensation was implemented to circumvent the FLSA’s requirement for overtime compensation” and avoid paying the plaintiff her rightful time-and-a-half wages.
