Filed: August 21, 2017 ◆§ 2:17-cv-01266
Dietz & Watson, Inc., which purports to be 'one of the largest preparers of premium deli meats and artisan cheeses,' is on the receiving end of a proposed collective action claiming it failed to pay its merchandisers proper wages.
Dietz & Watson, Inc., which purports to be “one of the largest preparers of premium deli meats and artisan cheeses,” is on the receiving end of a proposed collective action claiming it failed to pay its merchandisers proper wages. The plaintiffs claim they regularly worked at least 45 hours per week, and sometimes up to 70, but were improperly classified by the defendant as exempt from overtime wages. According to the suit, Dietz & Watson changed its pay policy in late 2016 or early 2017 to properly reflect that merchandisers were no longer exempt from overtime, but the complaint claims it still owes employees for the overtime wages they earned before the change.
Additionally, the suit alleges the defendant failed to provide its employees with meal and rest breaks and neglected to compensate them for any missed breaks.
