The plaintiff claims she worked around 63 hours per week for Deals on Broadway without appropriate compensation.
Alleged Fair Labor Standards Act (FLSA) abuses are the focus of a proposed collective and class action out of New York in which the plaintiff claims Deals on Broadway Corp. and its owner willfully failed to pay minimum, overtime and spread-of-hours wages. The complaint states the plaintiff worked as a stock person and customer service provider at the defendants’ store in New York City from April 2014 through February 2018. During her tenure, the plaintiff worked roughly 63 hours per week for a fixed daily cash salary, the lawsuit says, until April 2016 when Deals on Broadway began to pay her by check.
“Since April of 2016, when [the defendants] began to pay by check,” the complaint reads, “[the plaintiff’s] actual work hours are not being reflected on her checks. Instead, the overtime hours on the checks are greatly reduced to create the appearance that [the defendants] are in compliance with the FLSA and New York Labor Law.”
