Day Accessibility & Mobility Solutions is facing a lawsuit over its alleged failure to pay public projects workers at 'prevailing' hourly rates.

A proposed class action has been filed against Day Accessibility & Mobility Solutions, Inc. on behalf of a group of laborers, workers and mechanics who the plaintiff claims are owed unpaid overtime for work done on both private and publicly funded construction projects. The defendant, which is known as Day Elevator & Lift, Inc., allegedly failed to pay New York employees at the time-and-a-half overtime rate for all hours worked past 40 in certain workweeks between 2008 and the present.
At issue are public contracts entered into by the defendant that ensure the payment of wages and supplemental benefits at “prevailing” rates to employees working on public works projects. The case alleges Day Accessibility & Mobility Solutions “failed to ensure payment of the prevailing rates of wage and supplemental benefits” that proposed class members are entitled to.
