Davita Healthcare Partners, Inc. and Total Renal Care Inc. are facing seven different lawsuits filed in Colorado that accuse them of failing to pay proper overtime wages and provide accurate wage statements to their employees.
Davita Healthcare Partners, Inc. and Total Renal Care Inc. are facing seven different lawsuits filed in Colorado that accuse them of failing to pay proper overtime wages and provide accurate wage statements to their employees. The plaintiffs – who the suits say were all non-exempt, hourly employees – allege that their employers required them to perform work outside of their scheduled hours for which they were not compensated, including on weekends and during their lunch breaks.
The complaint further claims that the defendants denied employees’ requests to have their time records updated to reflect their actual hours worked. As a result, the case alleges, the plaintiffs and similarly situated employees are owed unpaid time-and-a-half overtime wages for all hours worked above 40 each week. The suits were each filed on behalf of employees who worked in the following geographical “zones” designated by the defendants:
- “Apex” zone - Montana, Kansas, Missouri, parts of Wyoming, Utah, Colorado, Nebraska, Oklahoma, Iowa, Illinois, Arkansas, and Texas;
- “Avanti” zone - Maine, New Hampshire, Vermont, New York, Massachusetts, Rhode Island, Connecticut, Pennsylvania, New Jersey, and Delaware;
- “Dream Team” zone - Arizona, California, and Nevada;
- “Endeavor” zone – Florida, parts of South Carolina, Georgia, and Alabama;
- “Polaris” zone - Washington, Oregon, Idaho, parts of California, Nevada, Utah, and Wyoming;
- “Team Fusion” zone - North Dakota, South Dakota, Minnesota, Wisconsin, Michigan, parts of Iowa, Illinois, Nebraska, Indiana, Ohio, Kentucky, and West Virginia;
- “Trailblazers” zone – Tennessee, Mississippi, parts of Indiana, Ohio, Kentucky, Alabama, and Georgia.
