A former employee claims Custom Fab Group Corp and NY Municipal Equipment failed to pay time-and-a-half overtime for all hours worked past 40 each week.

Custom Fab Group Corp. and NY Municipal Equipment are the defendants in a proposed collective action filed by a former employee who claims the companies and two individual owners failed to pay proper wages. The plaintiff, who the case says worked for the defendants as an auto body worker and fabricator from December 2011 through November 2017, claims he worked roughly 60 hours or more per week throughout his employment without being paid time-and-a-half overtime wages. The complaint alleges the defendants’ supposed non-payment of overtime violates the Fair Labor Standards Act (FLSA) and New York Labor Law.
