Fambro et al v. City of Atlanta
Filed: December 6, 2017 ◆§ 1:17cv4960
Three plaintiffs say they were paid compensatory time off instead of monetary wages for overtime hours worked each week.
Three Atlanta corrections officers have filed a lawsuit against the city over the Department of Corrections’ alleged policy of awarding compensatory time—commonly called “comp time”—in lieu of proper time-and-a-half overtime pay. The plaintiffs—two of whom are still employed by the city—allege they and members of the proposed collective were paid in comp time for working more than 171 hours in a 28-day work period, rather than in monetary compensation. The complaint says the city reportedly doles out one hour of comp time per each hour of overtime worked.
