Medellin et al v. Fleet Design Inc. et al
Filed: January 12, 2018 ◆§ 1:18cv241
Three plaintiffs claimBrooklyn construction co. Fleet Designs owes unpaid overtime wages and adjusted workers' paystubs to reflect fewer hours worked.
Three plaintiffs are leading a proposed class action against Brooklyn construction company Fleet Design, Inc. (which does business as Fleet Designs) and its owners over allegations of unpaid overtime wages. The plaintiffs, formerly employed by the defendants as ceramic and tile installers, claim they typically worked between 48.5 and 78 hours per week for wages that never varied no matter how many hours over 40 they worked. Each plaintiff alleges he was not required to keep track of his time while working for the defendants, who, the complaint claims, adjusted its employees’ paystubs to reflect a lower number of hours worked.
The complaint later claims the defendants required the plaintiffs and members of the proposed collective to buy their own “tools of the trade,” including grinders, gloves and masks, without reimbursement.
