A former construction worker has filed a proposed class and collective action against Wilcox Development Corp., Stop & Stor New York’s Self Storage Leader LLC, and two individuals alleging that they failed to pay their employees proper overtime wages.

A former construction worker has filed a proposed class and collective action against Wilcox Development Corp., Stop & Stor New York’s Self Storage Leader LLC, and two individuals alleging that they failed to pay their employees proper overtime wages. According to the suit, Wilcox provided construction and development services to Stop & Stor’s storage locations. The plaintiff says he worked more than 40 hours per week at these job sites but never received time-and-a-half overtime compensation for the weekly hours he worked above 40.
The complaint further claims that employees’ wage statements were inaccurate and failed to account for all their hours worked. Upon complaining to management, they allegedly received no response.
The suit seeks to cover a proposed class and collective of people who were employed by the defendants as construction workers, laborers, and demolition workers any time between July 20, 2014 and the entry of judgement in this case.
