Concrete Labor Services, Inc. and an individual with control over the business are staring down a lawsuit filed by a former employee who claims he worked between 20 to 22 overtime hours per week without being paid time-and-a-half wages.
According to the complaint, the plaintiff worked for the defendants from October 2016 through October 2017, earning an average of $17 per hour. The man alleges that despite being fully aware of the number of overtime hours he worked each week, the defendants “willfully and intentionally failed/refused” to pay him at the premium Fair Labor Standards Act (FLSA)-mandated rate for this work time.
