Complaint Alleges US Environmental Failed to Pay Field Service Techs Proper Wages

The plaintiff in a case against US Environmental claims he routinely works more than 40 hours per week without time-and-a-half overtime pay.
A proposed collective and class action has been filed against US Environmental Inc. on behalf of current and former field service technicians who the plaintiff claims were not paid proper time-and-a-half wages for all overtime hours worked. The case says the plaintiff worked cleaning oilfield tanks for the defendant from January through September 2017. Despite routinely working more than 40 hours per week, the lawsuit says, citing one particular week in which the man worked 76.5 hours, the plaintiff was only paid time-and-a-half wages for some overtime hours.
Moreover, the lawsuit claims US Environmental:
- Failed to record all hours worked by employees, including time spent traveling to work sites;
- Only paid its technicians wages for travel time based on “the fastest possible drive time,” rather than the actual amount of time workers spent traveling; and
- Automatically deducted meal breaks from techs’ pay even though the workers were reportedly not provided with a bona fide meal period.
