The operating entities behind South Carolina's Two Keys Tavern and Two Keys Public House are facing a former bartender's wage and hour collective action.

Keller Unlimited LLC and 57 Limited LLC, which do business as Two Keys Tavern and Two Keys Public House, respectively, and the companies’ owner are facing a proposed collective action stemming from allegedly unpaid minimum wages. The plaintiff, who the case says worked as a bartender at the sports bars from May 2013 through December 2016, claims she and similarly situated workers made less than the statutory minimum wage as a result of the defendants implementing an improper “tip credit” offset on their wages, and from improper deductions coming out of their pay for customer walk-outs, glass/plate breakage, and revenue shortages.
The plaintiff further claims the defendants took an overly nuanced approach to keeping track of inventory, with bartenders making up for any losses out of their own wages. From the lawsuit:
According to the complaint, the plaintiff’s paystubs reflect that the defendants regularly docked between $70 and $100 from her pay for “bar shortages.”
Per the Fair Labor Standards Act (FLSA) violations alleged by the case, the defendants’ supposedly required bartenders, whose income was primarily derived from customer tips, to spend more than 20 percent of their work time performing non-tipped duties around the restaurant, as well as regular off the clock work without pay.
