Columbia Gourmet Deli Corp. and two individuals with control of the business are facing a proposed collective action filed by two former employees who claim they are owed minimum, overtime, and spread-of-hours wages.
Columbia Gourmet Deli Corp. and two individuals with control of the business are facing a proposed collective action filed by two former employees who claim they are owed minimum, overtime, and spread-of-hours wages for the time they spent working at the deli. The plaintiffs were employed as delivery workers and allegedly received less than the tip-credit rate despite being required to spend more than 20 percent of each workday on non-tipped activities. According to the suit, the defendants also altered employees’ time records to reflect that they worked fewer hours than they actually worked, and one of the plaintiffs says he has still not been paid an entire week of wages.
The case further argues that the defendants failed to provide employees with required meal breaks, accurate wage statements, and notices regarding their rights under state and federal law.
