SK Beauty Supply (which is also known as Sassy Beauty Mart) and an individual with control of the business are on the receiving end of a proposed collective action filed by two former cashiers who claim they are owed unpaid overtime wages. The plaintiffs say they worked for the defendants between December 2017 and February 2018 and were paid an hourly wage of $17.50. According to the suit, they should have been paid at a premium rate for their overtime hours, from which they were allegedly misclassified as "exempt," but never received time-and-a-half wages despite working 57.5 hours per week.
Additionally, the complaint later accuses the defendants of filing misleading tax forms with the Internal Revenue Service by understating the amount of wages paid to employees “for their own wrongful enrichment.” The plaintiffs also claim their employers failed to pay Social Security and Medicare taxes on their behalf as required under federal law.
