Shima Limousine Services, Inc. and its owner are facing a proposed collective action in which the plaintiff alleges current and former chauffeurs are owed unpaid overtime. The plaintiff, who drove for Shima Limo from February 2016 through November 2017, claims the defendant’s drivers were often not paid on an hourly basis, but rather on a “per run” basis of roughly $12 to $18 per assigned ride. If members of the proposed collective were paid hourly, rather than in a piece-meal fashion, the lawsuit argues, their hourly rate of pay would sit at around $7, less than both the federal and Ohio minimum wage. The plaintiff adds the defendants consistently required drivers to work well beyond 40 hours per week without time-and-a-half pay.
