A former driver's helper claims the food distribution company failed to pay mandatory time-and-a-half overtime premiums between July 2017 and Feb. 2018.
Baily International of Atlanta and one individual with control over the food distribution company is on the receiving end of a proposed collective action in which a former driver’s helper claims he was not paid proper time-and-a-half overtime wages. According to the complaint, the plaintiff worked for the defendant from July 2017 to February 2018, during which time the man says he worked 65 hours per week without overtime pay for every hour worked in excess of 40 each week. The lawsuit estimates the plaintiff is owed more than $7,700 in unpaid overtime.
