Three current employees of Accredited Debt Relief, LLC have filed suit against the company and three individuals claiming the defendants violated several provisions of state and federal labor laws.
Three current employees of Accredited Debt Relief, LLC have filed suit against the company and three individual owners claiming the defendants violated several provisions of the Fair Labor Standards Act (FLSA) and California labor laws.
The plaintiffs, who are employed as call center agents, say the defendants have shirked their responsibility under the FLSA to accurately record employees’ hours and compensate them accordingly. The defendants allegedly don’t pay employees for the time it takes them to log on or off their computers and automatically deduct meal breaks from their wages regardless of whether they actually take a break. On top of that, the plaintiffs claim the defendants instruct managers to alter employees’ time records to reflect that they only work 40 hours per week and take unpaid breaks every day.
According to the complaint, the company pays the plaintiffs and other call center employees on a commission-only basis and miscalculates their regular rates of pay when determining their time-and-a-half overtime rate. As a result, the suit argues, employees are not properly compensated in accordance with the FLSA.
