Two operating companies of CJ Food Mart and four individuals with control of the business are facing allegations that they violated the Fair Labor Standards Act and New York Labor Law. The plaintiffs in the case are two former employees who supposedly spent more than 60 hours per week working at the Queens supermarket as meat department sales clerks. They claim they were paid a fixed weekly salary that amounted to less than the hourly minimum wage and didn’t include premium pay for the hours worked above 40 each week or above 10 each day. The suit further claims that employees were denied required meal breaks and accurate wage statements that recorded their hours and pay rates.
