The eight-page lawsuit was filed by two former employees who claim the Chipotle franchisee, which operates locations in Tennessee and other states, did not pay them and other hourly workers time-and-a-half wages for every hour worked over 40 per week, as required by federal law.
The suit alleges the company has a “common practice” of failing to accurately track employees’ overtime hours or “editing-out” the compensable extra hours from the time-keeping system.
As a result, in violation of the Fair Labor Standards Act (FLSA), the plaintiffs and other hourly employees were not paid proper overtime wages, even though they regularly worked more than 40 hours per workweek, the case contends.
The complaint charges the defendant acted with “reckless disregard” for the FLSA despite being fully aware of its requirements for employers.
The proposed collective action lawsuit looks to represent anyone who has worked as an hourly paid employee for Chipotle Services at any of its Chipotle-franchised locations in the United States at any time within the past three years.
