A lawsuit has been filed against four operating companies of New York Chinese herb store chain Wah Fung and two individuals with control of the enterprise.

A proposed collective and class action has been filed against four operating companies of New York Chinese herb store chain Wah Fung and two individuals with control of the enterprise. Filed by a current employee, the lawsuit alleges violations of the Fair Labor Standards Act (FLSA) and the New York Labor Law (NYLL).
According to the complaint, the defendants employed the plaintiff from February 1, 2015, to March 9, 2018, and again between March 26, 2018, through the present. The man claims he puts in more than 40 hours per week but isn’t paid for all the hours he works above 40, which the case notes should be compensated at a premium time-and-a-half overtime rate.
Furthermore, the lawsuit argues that the defendants fail to provide the plaintiff with proper rest breaks or accurate wage statements as mandated by state law.
