A proposed collective action has been filed against CHG Healthcare Services, Inc. and five companies under its umbrella in which two plaintiffs claim current and former sales consultant trainees were subject to company-wide policies that deprived them of all rightful wages.
According to the complaint, sales consultant trainees are paid a $40,000 base salary during six- to eight-week programs to become full-fledged sales consultants. The named plaintiffs allege the defendants—including CHG Companies, Inc.; CHG Medical Staffing, Inc.; CHG Management, Inc.; CompHealth Associates, Inc.; and Weatherby Locums, Inc.—view trainees as exempt from the minimum and overtime wage protections of the Fair Labor Standards Act (FLSA). More specifically, the plaintiffs allege sales consultant trainees are misclassified by the joint-employer defendants as exempt from FLSA protections and are thus owed unpaid minimum and time-and-a-half overtime wages.
