Two former employees of CentricsIT, LLC have filed suit against the company over claims that it misclassified them as exempt from overtime pay under the Fair Labor Standards Act.
Two former employees of CentricsIT, LLC have filed suit against the company over claims that it misclassified them as exempt from overtime pay under the Fair Labor Standards Act (FLSA). The plaintiffs, who worked for the tech support company as Customer Support Services Representatives, say they frequently worked more than 40 hours per week without receiving time-and-a-half overtime pay for the hours they worked above 40. They allege that they were often forced to work before and after their scheduled shifts and on days they were not scheduled to work.
Additionally, the defendant allegedly required its employees to be “on-call” every few weeks and paid them a fixed sum for each weekend they were on-call. The suit argues, however, that this extra payment failed to properly compensate them for all their overtime hours.
