A proposed class and collective action has been filed against Centennial Elevator Industries, Inc. and payroll outfit Automatic Data Processing, Inc. (ADP) in which a former Centennial employee claims he worked more than 60 hours per week without being paid time-and-a-half hourly overtime wages. Filed against the companies and three unidentified John Doe defendants, the lawsuit states the plaintiff is also owed unpaid spread-of-hours wages for days in which he worked more than 10 hours.
The plaintiff was employed by the elevator company from April 2004 through June 2017, the case says, starting out as an elevator mechanic until his promotion to Superintendent. The man claims that instead of time-and-a-half overtime pay, the defendants compensated him at only his regular rate for all hours worked.
The lawsuit singles out defendant ADP – Centennial's payroll processor – with the claim that the company “negligently processed 60 hours of pay on numerous occasions without calculating and paying overtime required under state and federal law.”
