Archuleta v. Caterpillar Inc
Filed: February 14, 2019 ◆§ 4:19cv121
A Caterpillar, Inc. production worker claims in a lawsuit that she was shorted on overtime wages and discriminated against based on her sex.
Arkansas
A Caterpillar, Inc. production worker has filed a proposed collective and class action lawsuit against the company in which she claims she was shorted on overtime wages and discriminated against based on her sex.
According to the case, the plaintiff works for Caterpillar, a leading manufacturer of construction and mining equipment, out of its Little Rock facility as the only female employee who performs duties associated with the job title “assembly III.” Despite her responsibilities, however, the plaintiff alleges she has been classified as “assembly II” for payroll purposes and paid less than her male counterparts for doing the same work. When she confronted her supervisors about the alleged pay discrepancy, the plaintiff, the suit says, was demoted and assigned duties associated with the “assembly II” position.
Moreover, the case takes issue with the defendant’s supposedly improper overtime pay practices. The suit says that production workers are paid an hourly rate plus non-discretionary performance bonuses, which Caterpillar allegedly failed to include when calculating employees’ hourly overtime pay rates.
