Atencion Family Services and its owner have been hit with a proposed collective from an employee who alleges she was not paid for all hours worked.

The suit, which was filed in New Mexico, alleges the defendants “allowed and directed” the plaintiff to put in over 40 hours each week as a caregiver responsible for “providing companionship services” to clients. According to the suit, the woman clocked in and out based on when she arrived and left clients’ homes but was only paid for some of her logged hours.
“Defendants retained the benefit of Plaintiff’s labor without paying Plaintiff for her labor,” the suit charges, adding that the woman is owed both straight-time and overtime wages.
