A former employee of Cabo Restaurant has filed suit against its two operating companies and an individual who controls the business over claims that the defendants denied him his rights under the Fair Labor Standards Act.

A former employee of Cabo Restaurant has filed suit against its two operating companies and an individual who controls the business over claims that the defendants denied him his rights under the Fair Labor Standards Act. The plaintiff says he worked as a busboy and food runner at the defendants’ restaurant between May 2016 and November 2017 without being paid proper minimum, overtime, and spread-of-hours wages. According to the suit, he worked approximately 58 to 64 hours per week and was paid $30 per shift without any extra wages or overtime premium. The complaint also claims the defendants never notified employees that they would be taking a tip credit and failed to keep track of the amount of tips employees received.
