The respective operating companies of Star Natural Meats, Old Fashioned Butcher, and Prime Meat, along with two individual owners of the businesses, are defendants in a proposed collective action that alleges violations of federal and state labor laws. The plaintiff in the case, who the suit says worked as a butcher at each of the defendants’ three locations, claims he worked an average of at least 60 hours per week without receiving time-and-a-half overtime wages and without being compensated for the time he worked beyond his scheduled shifts. According to the complaint, the defendants also failed to pay him spread-of-hours wages for each shift he worked that lasted longer than 10 hours, an alleged violation of the New York Labor Law.
Moreover, the complaint alleges that the defendants failed to provide the plaintiff and similarly situated employees with proper meal and rest breaks, accurate wage statements, and posted wage notices that detailed their rights under state and federal law.
