InterContinental Hotels Group—which operates Holiday Inn, Crowne Plaza and numerous other hotel brands—joins LinGate Hospitality, LinGate and Burger Theory as a defendant in a proposed collective action filed by three tipped employees over allegedly improper wages.
According to the case, the plaintiffs worked as servers and bartenders at a Burger Theory restaurant located in a Paducah, Kentucky Holiday Inn. Despite their job titles, the women allegedly washed dishes and linens, cooked fries, and bussed tables, among other non-tipped tasks, for more than 20 percent of each shift. Further, the plaintiffs claim they were unlawfully required to share their tips with cooks, housekeeping employees and other non-tipped workers. The case argues the defendants’ tip credit was rendered invalid given their tip pooling arrangement and the plaintiffs’ actual responsibilities, meaning the workers should have been paid at least the full minimum wage.
