Brooklyn’s Arch Diner Hit with Lawsuit Seeking Unpaid Wages

Kanoni, Inc. and an individual owner are being sued by three former employees seeking allegedly unpaid wages.
Kanoni, Inc. and an individual owner are being sued by three former employees alleging that the defendants, who own and operate Brookyln’s Arch Diner, failed to pay lawful minimum, overtime, and spread-of-hours wages. The plaintiffs claim that the defendants paid them a fixed weekly salary or a fluctuating hourly tipped wage, neither of which provided the legally required minimum wage for each hour worked. Moreover, despite regularly working over 40 hours per week, the plaintiffs claim they did not receive lawful time-and-a-half overtime wages or spread-of-hours pay. When the plaintiffs were being paid an hourly tipped wage, they received no compensation aside from tips for hours worked after 40, the lawsuit says. Furthermore, the case claims that the defendants automatically deducted one hour’s pay from each shift worked regardless of whether the plaintiffs were able to take an uninterrupted hour-long break.
The plaintiffs seek to recover their allegedly unpaid wages as well as compensation for “unreasonably delayed payment of wages” and reimbursement for uniform costs, the suit says.
