A proposed collective action has been filed against BNSF Logistics, LLC; BNSF Railway Company; and Transportation Technology Services Inc. over claims that the defendants misclassified their welders as independent contractors and denied them premium overtime pay. The plaintiff says he was employed as a rig welder between 2015 and 2017 and was paid an hourly rate that didn’t include time-and-a-half wages for any hours he worked above 40 in a week. He claims the lack of overtime pay was a result of the defendants’ misclassification of welders as independent contractors, despite maintaining control over most aspects of their job.
