Behind the suit is a former dispatcher who says he worked for the trucking company from November 2016 to September 2018. The plaintiff supposedly received a flat weekly salary that did not vary depending on the number of hours worked, which resulted in the man effectively being paid at an hourly rate that fell below the federally mandated minimum wage, the case claims.
Although the plaintiff was scheduled to work at least 40 hours each week, the case continues, he was required to remain available all day for calls from the defendant for an average of seven out of every 14 workdays. The case claims that he did not receive overtime pay for this time and that the defendant failed to maintain time-keeping records for any of its employees.
The suit further alleges the company breached its agreement to pay the ex-dispatcher a three-percent commission on profits generated by deliveries he placed and failed to issue the man’s salary on his regularly scheduled payday.
