Allegedly unpaid overtime wages are at the heart of a proposed class action filed against Bethany Home Health Services.

In-home healthcare provider Home Quality Care Home Health Care, Inc., which operates as Bethany Home Health Services, and its two owners are facing a proposed class action lawsuit out of Texas claiming the parties violated the Fair Labor Standards Act’s Portal-to-Portal Pay provision. The case’s two named plaintiffs, one of whom worked as an office employee, the other as a traveling in-home nurse, allege they and other office staff and home health workers “regularly and customarily” worked more than 40 hours each workweek yet were not paid time-and-a-half hourly overtime.
The complaint goes on to allege the defendants, in December 2016, stopped paying the plaintiffs and proposed class members. The workers were paid eventually, the case claims, but not at proper FLSA-mandated rates.
