Ben’s Kosher Delicatessen & Restaurant Inc., Ben’s Restaurant Group, Inc., and Country Glen Kosher Restaurant, Inc. have been named in a former employee’s proposed collective action that accuses the defendants of violating labor laws. The plaintiff says he worked at one of the defendants’ delis between September 2008 and November 2017 as a busboy and was paid an hourly wage of $5.00 plus tips, which was later raised to $7.50 in January 2016. He argues that his employers never provided him notice of the tip credit and therefore should have paid him the full minimum wage in accordance with state and federal law.
The suit further claims the man was not provided with wage statements or notices and was never reimbursed for purchasing three t-shirts marked with the defendants’ logo that he was required to wear as his uniform.
