A Nutley, New Jersey man claims in a proposed class and collective action lawsuit that Bell-Mark Technologies Corporation owes unpaid overtime wages. The plaintiff, who worked as a regional sales manager for Bell-Mark from July 2015 through August 2017, alleges he and similarly situated employees were essentially forced by the defendant to “perform a combination of non-exempt duties as their ‘primary duty’” off the clock beyond the end of their shifts—and in excess of 40 hours per week—without time-and-a-half overtime pay and certain commissions for this additional work time.
