A proposed class and collective action out of New York claims Beauty Sleep, Inc., Mattress Direct Incorporated, and one individual owner violated federal and state labor laws by failing to pay the plaintiff lawful minimum and overtime wages. The plaintiff, who worked as a mattress sewer for the defendants from January 2014 through May 2018, claims she regularly worked in excess of 40 hours per week for a fixed weekly salary that failed to compensate her properly. The lawsuit alleges that the plaintiff’s fixed pay rate ranged from $350 to $550 per week throughout her employment period regardless of hours worked, and deprived her of required minimum and time-and-a-half overtime wages.
