Three plaintiffs have filed a proposed class and collective action against RCL Management, LLC, which does business as B-Side Complex, in which they claim the restaurant/nightclub/bar operating company and its owners failed to pay proper wages.
Three plaintiffs have filed a proposed class and collective action against RCL Management, LLC, which does business as B-Side Complex, in which they claim the Philadelphia restaurant/nightclub/bar operating company and its owners failed to pay proper wages. The plaintiffs, who worked in serving and bartending roles, claim they were never paid any direct cash wages by the defendants, with their compensation instead coming solely from tips. According to the complaint, the defendants never notified the plaintiffs that the tips would be used to satisfy their minimum wage obligations.
Moreover, each plaintiff claims he or she was never provided with dinner breaks, and instead routinely worked through this time without commensurate pay. The case rounds out by alleging the plaintiffs were required to reimburse the defendants from their own tips for customer walk-outs or credit cards that were declined after a customer already left the premises.
