Two employees of AW Lins Asian Cuisine Downtown Little Rock, LLC have filed suit against the restaurant and two individual owners claiming they were not paid proper wages. The defendants allegedly require servers and bartenders to contribute to a tip pool from which tips are distributed among employees, including management. The suit argues that this tip pool arrangement is illegal under the Fair Labor Standards Act and that the plaintiffs – a server and a bartender – must be paid the full minimum wage if the defendants continue distributing their tips to non-tipped employees.
