Fernandez De Jesus et al v. Incinia Contracting, Inc. et al
Filed: July 28, 2017 ◆§ 1:17-cv-05733
Two former Incinia Contracting asbestos handlers have sued the company claiming they're owed unpaid time-and-a-half overtime wages.
New York
Two plaintiffs have filed a proposed class action on behalf of individuals currently or formerly employed as asbestos handlers in New York and New Jersey by defendants Incinia Contracting, Inc., Incinia Corporation, and the companies’ owners. The defendants, who the case describes as operators of a “full service environmental company,” allegedly failed to pay the plaintiffs and proposed class members proper wages, namely time-and-a-half hourly overtime wages for all hours worked past 40 each week. The plaintiffs say they worked between 48 and 80 hours per week during their employment without proper wages.
