The operating companies and owners of Arizona-based restaurant chain Eggstasy have been hit with a proposed collective action in which two former employees claim they were not paid lawful wages.
The plaintiffs, who worked at the restaurant as servers, allege the defendants violated the Fair Labor Standards Act (FLSA) by applying a tip credit to the workers’ wages without first notifying them.
The suit says the defendants further violated federal law by taking unlawful deductions from the plaintiffs’ pay, purportedly “to cover the cost of optional employee food and drink allowances.” These deductions, the case explains, caused employees’ pay to fall below the federal minimum wage.
The plaintiffs also claim their pay was further reduced when they had to attend weekly off-the-clock staff meetings that resulted in unpaid minimum and overtime wages.
