A former employee claims Annellie's Car Wash paid a piece-rate of $3 per car, putting workers' hourly pay below the federal mandatory minimum.
A Florida man alleges in a lawsuit that he worked a total of 30 hours per week for defendant Annellie’s Car Wash between December 2015 and September 2016 without being paid proper hourly minimum wages. The plaintiff claims he and similarly situated tipped employees were paid a piece-rate of $3 per car, which the lawsuit says pegged his regular rate at only $2.66 per hour, far below the federal minimum of $7.25. More specifically, the lawsuit alleges the defendant improperly classified the plaintiff and other car wash workers as independent contractors rather than employees.
The case rounds out by noting the defendant allegedly fired the plaintiff on September 24, 2016 after the man complained once again of the car wash’s supposed refusal to pay minimum wages.
