AmeriHealth Caritas Services, LLC is on the receiving end of a proposed class and collective action filed by a current employee who claims she does not receive proper overtime wages. The lawsuit alleges that the plaintiff and others working as Clinical Care Reviewers are misclassified as exempt from overtime requirements under the Fair Labor Standards Act. Though the plaintiff and similarly situated employees regularly work more than 40 hours per week, according to the complaint, they allegedly do not receive any time-and-a-half overtime wages for the hours they work above 40.
