A lawsuit claims American Strategic Insurance Corp. and two subsidiaries illegally misclassified insurance adjusters as exempt from overtime wages.
Florida
A proposed collective action out of Florida claims American Strategic Insurance Corp. and subsidiaries ASI Underwriters Corp. and ARX Executive Holdings, LLLP have, within the last three years, failed to pay individuals employed as adjusters and team leads proper overtime wages. The lawsuit’s two lead plaintiffs claim the defendants misclassified adjusters and team leads as independent contractors exempt from overtime, paying them only a straight hourly rate for all hours worked and not time-and-a-half overtime as required by the Fair Labor Standards Act (FLSA). The lawsuit lays out the details of an ostensible employer-employee relationship between proposed class members and the defendants, and claims the plaintiffs and similarly tasked employees regularly worked between 10 to 30 overtime hours per week without being properly compensated.
