A former employee has filed suit against home healthcare providers American Home Patient and Lincare seeking allegedly unpaid overtime wages.

A former employee has filed a proposed collective and class action against home healthcare providers American Home Patient, Inc. and Lincare, Inc. seeking allegedly unpaid overtime wages.
According to the lawsuit, the plaintiff worked as a certified respiratory therapist for both defendants, who merged during her employment, from October 2014 to July 2017. She alleges that she regularly put in more than 40 hours per week but “was not paid time and one-half her regular rate of pay for all hours worked in excess of forty (40) per work week during one or more work weeks.” The suit further alleges that the plaintiff and similarly situated employees “routinely had their timecards modified” by management to unlawfully withhold overtime compensation.
