Ambi Paving LLC and an individual with control of the business have been named in a proposed class action alleging the defendants didn’t pay their employees any overtime wages. The plaintiff says he worked for the paving company as a truck driver/driver’s helper and alleges that he and other employees were paid a fixed “salary” that was meant to cover a 40-hour workweek. Despite performing non-exempt duties, the case continues, employees were allegedly denied federally mandated time-and-a-half overtime wages when they worked more than 40 hours per week, which the plaintiff says happened during “some or all” pay periods.
