Allstate Interior & Exterior Contractors, Inc., Allstate Painting Corp. and their owner, who do business as Allstate Painting, are the defendants in a proposed class action claiming employees were not paid proper overtime or spread-of-hours wages. The plaintiff, who handled painting, construction, driving and repair work from 2004 through 2017, claims he worked - without receiving time-and-a-half overtime pay - between 72 and 74 hours per week from 2011 through November 2014 and 48 hours per week from December 2014 up until his departure. His tenure with the defendants, the plaintiff added, included unpaid off-the-clock work and the requirement that he falsify records of his hours worked in order to receive his weekly pay.
