The Triumph Group Operations and APA Aviation Services are the defendants in a former employee’s lawsuit filed over allegedly unpaid overtime wages.

The Triumph Group Operations, Inc. and APA Aviation Services, LLC are the defendants in a former employee’s proposed collective action that alleges the companies “purposefully and knowingly misclassified” the plaintiff and similarly situated workers as independent contractors exempt from overtime pay.
According to the case, the plaintiff worked an average of 10 to 15 overtime hours each week for the companies as a senior aircraft painter without proper time-and-a-half pay. The lawsuit argues the man should have been designated as a non-exempt employee since the defendants controlled all aspects of his job, including his schedule, company policies and work assignments.
