A former employee of Deployed Data Solutions claims was misclassified as an independent contractor and deprived of proper wages.
Telecommunications company Deployed Data Solutions and its owner have been named in a lawsuit in which a former employee claims he was misclassified as an independent contractor and deprived of proper wages.
The plaintiff received $20 per hour working as a technician responsible for installing and repairing cable lines, according to the complaint. The case alleges the defendants designated the man as an independent contractor to “evade” paying him time-and-a-half overtime wages; however, the suit argues that the plaintiff did not meet the qualifications of an independent contractor as his employers controlled most aspects of his work, including his hours, pay rate and assignments.
Further, the plaintiff claims he was not paid for all hours worked as he was not compensated for time spent traveling overnight to distant worksites.
