A proposed collective action has been filed against Fleetgistics Holdings, LLC; Scriptfleet, LLC; Partsfleet, LLC; Partsfleet II, LLC; and Medifleet, Inc. by a former employee who claims he was misclassified as exempt from receiving overtime wages while working for the defendants as a logistics manager. The man alleges his primary duties were not managerial in nature and required no formal education or specialized training. According to the suit, the plaintiff oversaw a group of independent contractor drivers but “was not free to make significant decisions affecting the company without approval from his superiors,” such as fire or terminate the contracts of said drivers.
The plaintiff claims he often worked between 60 and 70 hours per week but never received premium time-and-a-half wages for the hours he worked over 40. He says he and other logistics managers were required to be on-call “24/7” and would often work on weekends without proper pay.
